Yes you can get your paycheck. If the amount is less than the maximum amount for filing a claim in small claims court in the jurisdiction in which you live you may do so and have your case heard by a judge in small claims court. Your friend may also want to do the same as the combined testimonies from both of you will get the judge to rule in your favor and you may obtain a judgment against your ex-boss. Were your ex-boss to tell the small claims court judge you stole something from him it will not have a bearing on the case. What will have a bearing on the case is your proof of work so you can show the court you ex-boss owes you back pay. I suggest filing in small claims court as soon as possible so you can get the money before he leaves as he may decide to close up shop and ditch his obligations.
